A separation agreement is a formal agreement signed by a husband and wife which settles all of the issues that must be decided during a divorce.  Some of the issues include how the marital property will be divided, the terms of maintenance and child support, a parenting plan for custody and a visitation schedule. This separation agreement will then be incorporated into the parties Judgment of Divorce.
